Applicable law
In construction contracts the term 'applicable law' refers to the legal jurisdiction whose laws and regulations will govern the contract and any disputes arising from it. This clause determines which country's laws will apply in interpreting and enforcing the terms of the contract.
For instance, a construction contract in the UK might specify that English law is the applicable law. This means that in the event of a dispute or legal issue related to the contract, the laws of England will be used to interpret the terms, determine the rights and obligations of the parties involved, and resolve any conflicts.
It is a crucial clause as it helps provide clarity on the legal framework within which the contract operates, ensuring consistency and predictability in case legal issues arise during or after the completion of the construction project.
This is particularly important on projects that cross international boundaries, or where the parties to the contract may be operate globally or may come from different countries.
